Today’s SCOTUS opinion on Bostock v. Clayton County will be the most discussed and debated by both political parties. Why? Because we live in the times of –isms. This particular decision was about employment and sexual orientation.

If you read the majority opinion, written by Justice Gorsuch, almost any 21st century citizen will understand his intent. Moreover, I would wager that a super majority would agree with the opinion. The court sided with Bostock and said that his termination, based on his sexual orientation, was unlawful.

The question or the immediate debate will be, did the court, in ruling the way it did, ensure that the Pandora’s Box that was opened as early as the first controversial ruling of the court, remain, at least for now, open!

‘What do I mean?

The Act or Law at issue is Title VII of The Civil Rights Act of 1964. The dissent states that the court is adding to the text of the law, and thereby overstepping it’s role. As a non-legislative body, it has to adhere to the original text and intent of the law at the time the act was passed.

This is where passions get enflamed. Reasonable people will disagree. The disagreement will not hinder on the “unfairness” of employment decisions solely on the basis of “sex” or in this current case, “sexual orientation.” The disagreement will be on whether it was the role of the court to infer a text and therefore an intent that wasn’t there to begin with. Why? Because sexual orientation was not included in Title VII.

Of course there will the usual permutations that would be debated. What if an employer, let’s say the NBA, denies a WNBA player from trying out for a team and therefore the franchise that has been traditionally male – does that violate Title VII? Stuff like that. Oh, don’t think that that’s far fetched. In 1964, there was no debate to using a restroom based on what you thought your gender was.

There were three decisions today. It is for certain, that almost all three will be criticized by members of the citizenry, on merits but ultimately, jurisdiction. As of today June 15, 2020, they are the law of the land. That is until a future SCOTUS opinion reverses them.

This ultimately proves that the check on the three bodies of our governmental structure, Our Constitution, ARE THE PEOPLE.

The video of the fatal shooting of Rayshard Brooks has been released. My take is that he shouldn’t have died. However, it’s not as cut and dry as the George Floyd video. Other officers could weigh in and tell us how this could have been handled differently, wherein Mr. Brooks would still be alive. Or was this just tragic and the officers followed procedure?

Given what you saw in the entirety of the video, could the officers have exercised discretion specially at the time where he was out of the car and said he’ll walk home? Is that possible and could the Atlanta PD have liability if they let him walk home? Could they have waited for someone to pick him up? Again, liability?

In a 10 minute clip of a video on William F. Buckley’s Firing Line, a Socialist was politely doing his best to advance and justify Affirmative Action. He said so much with so little to show for it. By contrast, Thomas Sowell, a Renowned Economist, said little and at the same time said much, for the ineffectiveness of a program designed with Social Justice in mind. Here’s the clip.

Having watched the entire episode, one of Thomas Sowell’s quotes seems apt.

On a general note unrelated to the clip, I remember three questions proposed by Dr. Sowell that should make anyone think about proposed actions or programs that have a “social” component to them.

They Are:

1. Compared to what?
2. At what cost?
3. Do you have any evidence?

At 84 years of age, Walter E Williams shares insight and wisdom on the research he’s done on the plight of black people in America. The article, if you already agree with his views, will add the missing information, that confirms what you knew but couldn’t quite sew up. If you are of the opposite view, at least digest the information and tell Dr. Williams where he’s wrong, or what he’s missing.

The answer to information you disagree with, (bad speech) is more information. (more speech) It is never acceptable to quell peaceful disagreeable speech.

In a recent interview with Mark Levin, Dr. Williams informed the audience that his friend Thomas Sowell is releasing a new book this month. Make sure to get a copy!

It doesn’t matter who you are or what you’ve been doing with your life, this destruction and takeover of American Cities, is your fault!

Your color is not an exemption. Black, Hispanic, Asian, – doesn’t matter, it’s your fault.

Now, if you’re white, we have something special just for you. Shhh, be quiet and accept your shaming and beating.

Oh, take your wallet out too. What’s that? You don’t have enough money even for yourself? Doesn’t matter, it’s systemic, so cough it up.

What’s that you say? You’re married to someone of color. Who cares!

Who can you “plead” your case to? No one! It’s been decided. By who? Who knows! Who cares! You ask too many questions. Didn’t I tell you it’s systemic.

Just do what you’re told. This is your life now.

What’s that? What’s the plan? Plan for what?

Rules? Rules are for oppressors! Check your GD privilege!

What’s that? You don’t have privilege, you don’t know what that means? See, that’s why you’re the problem! You’re an idiot! You have privilege because we said so.

What’s that? You’re an immigrant. Well you’re stupid! Why would you go to this hellhole? Serves you right!

Now, when you’re done being all shocked and all that BS, go figure out how we can get food, clothing and shelter.

What’s that? You were doing that already and it’s hard. No, you insensitive pr!%k! Now, figure it for all of us!

What’s that? What about your job? You worked hard for it you say?The business is now gone? Well see, those selfish SOBs just closed down and left.

What’s that? What about your kids? Oh, that’s easy. Did you think we were heartless? Just keep taking care of them along with our kids.

What’s that? What now? Shhhh, we’re trying to think. We had this figured out already.

What’s that? Where has this worked? Would you stop with all the questions. Can’t you see we’re busy being responsible.

George Floyd’s home was Houston Texas not anywhere in Africa. He was killed by one officer and the negligence of three others, not the entire Minneapolis Police Department. The whole country had nothing to do with the killing.

Majority of us Americans were busy dealing with the complexity of our own lives trying to feed ourselves and our families, barely having time for our interests, much less have time to be systematically oppressing someone. But make no mistake, we were extremely bothered by what happened and we wanted answers and justice. And I mean WE. REGARDLESS OF EVERY TRAIT YOU CAN THINK OF!

The pandering Democrats in the photo have a combined tenure in government of over one hundred years. That party has been running cities like Minneapolis where these killings occur. To be fair Republicans pander and fold as well. However, the photo-op, and THIS was a photo-op, illustrates the problem clearly!

Most members of both parties don’t see us as individuals anymore! They look at us as members of groups. And because they don’t see us as individuals, each with a complicated array of traits that makes us unique, they’ve reduced everything to – if one member of the group does X, then all members behave the same way.

They take ONE trait and make it essential to that individual instead of just incidental. I’m proud of my heritage as a Filipino, but that’s just one aspect of me. George Floyd was black, also, just one aspect of who he was. How insulting that he’s reduced to just a color.

Then adding insult to injury, he’s not even considered just American! He had to be African. Ask most blacks and they’d tell you that if you would have to characterize them, characterize them as black. That’s it. No hyphenated descriptions.

When we’re not seen as individuals, our accomplishments and our failures are not our own. It belongs to whatever group we’ve been assigned to.

So, punish the individual(s) who were responsible for the wrongdoing and leave the rest of us alone. We don’t need to check anything. My white friends, and I have many, did not do anything to George Floyd or anyone like him. They’re all just trying to live the best life they could. Most of us are.

So spare us the fake concern and do the main job we elected you for. Protect us! All of us! That’s really the only job that matters. The rest, we can figure for ourselves. We do that day in day out. How do you think we’ve become the most powerful and righteous nation on the face of the earth? Yes, I said righteous! Deal with it.

Turmoil, chaos is not new to the human experience. The excerpt above, from Alexander Hamilton, gives us an idea of his observations during such times.

In troubled times such as these, I could be a pessimist and not lose. Pessimists never do. Or, I could as I have tried to do, be cautious, aware, but ultimately optimistic. There’s a big chance I could lose in my optimism of things to come. However, I’m encouraged in it, because of the underlying essence of the unrest we are in. I’ll explain what I mean shortly. But first, let me share a story that one of our past presidents loved to tell. This President led us out of difficult times. To be sure we’ve had many. This particular one however, had a knack for telling stories that disarmed even his fiercest critics.
The Gipper – Ronald Reagan – our 40th President

This particular story of his, was, in my view, The Gipper’s way of refocusing his troops. In that, when all they see is hardship, challenges and mayhem, he had them look for the good they can glean from dire situations.

The story…

Now to my optimism and why I think there’s a pony in our future. The underlying essence that is there to see, in all that has transpired, is our collective value for life and justice. We locked down, rightly or wrongly, to save as many lives as we can from a novel virus that killed and continues to do so. We asked to be let go, and to let us continue with our lives, because we were willing to face danger, to again save our lives and of those we love, by providing for them, so nobody else has to.

Then, we were collectively angered, when we saw a man murdered by people sworn to protect lives. Not only were we angry, we also felt helpless and betrayed. That combination turned our anger into outrage! We lashed out! Some with words and screams and civil disobedience.

Sadly however, we also saw more senseless death and destruction. We forgot the advice we’ve been given ages ago, – never act in anger, more often than not, you’re bound to regret it. For sure there will be regrets. With the multiple crises we’ve gone through, it’s guaranteed. But, we will endure. We always do.

So, let’s not destroy our institutions. Instead, let’s strengthen them. We weed out the bad ones, as we do in any institution we erect to serve and protect us. But we also need to look inward. – To be circumspect. John Kennedy had that famous line about country and individual. My interpretation of it is not necessarily literal. I believe he was asking us to ask ourselves, how we can better our own lives and in turn further strengthen our country.

As a nation, we’ve had our fights. We were at blows. Blood was drawn. But first and foremost, we are Americans! We value life! We die for justice. Perfect, we are not. But we are still that beacon of hope, and I agree with The Gipper, – We are still That Shining City On A Hill.

I got a message from a much wiser older cousin who sent me a link to an open letter to President Trump. My cousin also reminds me that we should pray harder. Advice heeded and adopted.

President Trump gets an open letter from an unlikely ally. Unlikely because he’s been lambasted by church leaders. Most recent and prominent of those critics is Washington’s Archbishop Wilton Gregory who criticized The President’s timing when he visited “The John Paul II Shrine” in Washington D.C. So when Titans attack another Titan comes ready to defend.

Former Apostolic Nuncio to the United States of America. The letter is edifying. It also shows that groups, whether by race, religion etcetera, don’t always speak in one monolithic voice.

Another way of asking this question, but not limited to these two – is – should the sins of the father be borne by the son? These questions are framed to solicit feelings of unfairness. I also purposely used the word borne instead of “paid” and I’ll explain why shortly.

Is it really just unfair? Unfair is someone jumping in line or something like that. The idea contained in the questions are worse than unfair – it’s unjust! But that’s exactly what some are asking us to do. Do the time for someone else’s crime.

I used borne instead of paid because the same people are saying that sins that were committed over one hundred years ago, need to be perpetually borne by people who had nothing to with them. If I used paid, it says that the debt will finally be squared. But it can never be squared – not to them. So borne is appropriate in the sense that we are collectively bearing the debts of the past. How? When the gentrified class claims endemic social injustice, it assigns the sins of the father on the son. We are – the son.

Out of respect for your time, I’ll just post two pictures and explain in them who were perpetrators and should pay for their actions and who were innocent “sons” being made to suffer the consequences of the actions of the perpetrators.

These officers were responsible for the specific injustice of George Floyd’s death.

These are victims of the injustice of the riots. These victims were made to pay for sins they did not commit.
